I donated to FIRE for the first time a few days ago. Just want to say I’m extremely grateful for the work you and all the folks at FIRE do Greg. Huge fan of you and Jonathan Haidt. Also, Jacob Mchagama’s podcast on free speech is great and this post reminded me to get his book so thanks for that as well. Happy holidays. Cheers!
Earnest question for you, Greg: I just watched your interview on The Free Press and was a bit surprised by your take on the ABC defamation lawsuit brought by Trump.
Why do you suggest the case is based on too little evidence of defamation?
In the interview, you didn’t reference any comparative analysis of similar cases to support your conclusion, nor did the discussion explore the topic in depth. As a result, I found your position unconvincing and would really appreciate a clearer explanation.
Is this something you’d consider writing more about? I think many of your readers would find it valuable.

Thank you Justin!
You must have forgotten to include Samantha Barbas’ Actual Malice, a recent history of New York Times v. Sullivan.

To restate briefly: more in depth exploration of the “actual malice standard” please 🙏🏼
